Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Reasy platform, website, and related services (together, the "Services"), provided by Reasy Pty Ltd (ABN pending) ("Reasy", "we", "us", "our"). By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. The Services

Reasy provides an online platform that enables property owners in Australia to list and manage the private sale of their own residential property, and allows prospective buyers to browse listings and communicate directly with sellers. Reasy is not a real estate agent, does not represent either party, and does not provide legal, financial, or property advice.

2. Eligibility

To use the Services you must be at least 18 years of age, have legal capacity to enter into a binding contract, and (if listing a property) be the registered owner or have authority from the registered owner to list the property for sale. You are responsible for ensuring that your use of the Services complies with all laws that apply to you.

3. Accounts

You must provide accurate, current, and complete information when creating your account, and keep your account details up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorised use of your account.

4. Identity verification

We may require you to complete identity verification, including providing government-issued identification and documents establishing ownership of any property you list. You consent to us collecting, verifying, and retaining this information in accordance with our Privacy Policy.

5. Fees

Reasy uses a gated pricing model. Applicable fees are:

  • Listing fee: payable when you publish your listing, covering identity verification, title search, and listing setup;
  • Accept first EOI fee: payable when you accept your first expression of interest, unlocking full platform features;
  • Settlement fee: payable on completion of settlement, confirmed by your conveyancer.

All fees are displayed in Australian dollars and are inclusive of GST unless stated otherwise. Fees are non-refundable except where required by law. We may change our fees from time to time; changes will apply only to new listings created after the change takes effect.

6. Seller responsibilities

If you list a property on the Services you agree that:

  • You are the owner of, or have authority to sell, the property;
  • All information you provide about the property (including photographs, descriptions, dimensions, and price) is accurate, current, and not misleading;
  • You will comply with all laws applicable to private property sales in your state or territory, including disclosure obligations, vendor statement requirements, and anti-discrimination laws;
  • You will respond to enquiries in good faith and handle all communications with buyers respectfully;
  • You understand that Reasy does not act as your agent and that all negotiations, inspections, and decisions are your responsibility.

7. Buyer responsibilities

If you use the Services to enquire about or offer on a property, you agree that:

  • You are genuinely interested in the property and will not submit frivolous or misleading enquiries;
  • You will conduct your own due diligence, including arranging building and pest inspections and obtaining finance pre-approval where appropriate;
  • You understand that Reasy does not provide valuations, recommendations, or endorsements of any listing;
  • You will engage your own legal representative to act on your behalf before entering into a binding contract of sale.

8. Conveyancing and legal advice

The Services may facilitate introductions to third-party conveyancers or solicitors. Any engagement you enter into with a conveyancer or solicitor is directly between you and that professional. Reasy is not a party to that engagement, does not receive commissions from the professional, and is not responsible for the services they provide.

9. Content you provide

You retain ownership of any content (including photographs, text, and documents) you upload to the Services. By uploading content, you grant Reasy a non-exclusive, royalty-free, worldwide licence to host, display, reproduce, and distribute that content solely for the purpose of operating and promoting the Services. You warrant that you own or have permission to use all content you upload and that it does not infringe the rights of any third party.

10. Prohibited conduct

You must not:

  • List property you do not own or are not authorised to sell;
  • Provide false, misleading, or deceptive information;
  • Harass, abuse, or discriminate against other users;
  • Use the Services to circumvent platform fees, including by agreeing with another user to complete a transaction off-platform to avoid the Settlement fee;
  • Attempt to access accounts or data that do not belong to you;
  • Introduce malicious code, scrape the Services, or interfere with their operation;
  • Use the Services for any unlawful purpose.

11. Intellectual property

The Services, including all software, designs, graphics, logos, and written content (other than user-uploaded content), are owned by Reasy or licensed to us and are protected by Australian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

12. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Reasy makes no warranties or representations, express or implied, regarding the accuracy, reliability, completeness, or availability of the Services, or regarding any particular listing, user, or outcome. Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, right, or remedy that cannot be excluded under the Australian Consumer Law.

13. Limitation of liability

To the maximum extent permitted by law, Reasy's total liability to you arising out of or in connection with the Services is limited to the amount of fees you have paid to Reasy in the twelve months preceding the event giving rise to the claim. We are not liable for any indirect, consequential, or special loss, including loss of profit, loss of opportunity, or loss of data.

14. Indemnity

You agree to indemnify Reasy and its officers, employees, and contractors against any claim, loss, damage, or expense (including reasonable legal costs) arising from your use of the Services, your breach of these Terms, or your breach of any law or the rights of any third party.

15. Suspension and termination

We may suspend or terminate your account at any time if you breach these Terms, engage in conduct that harms other users or the Services, or otherwise at our reasonable discretion. You may close your account at any time by contacting us. Termination does not affect any rights or obligations that accrued before termination.

16. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on our website. We will notify registered users of material changes by email or through the Services. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

17. Governing law

These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia in respect of any dispute arising out of these Terms.
